General Terms and Conditions (GTC) for our online shop

For all orders that you place via our online shop at www.epitome.inc (hereinafter referred to as the 'online shop'), the following General Terms and Conditions apply in the version valid at the time of your order. Deviating terms do not apply unless we expressly agree to them in writing.

1. Scope

1.1 The contractual partner for all purchase contracts that buyers (hereinafter referred to as 'customer' or 'you') conclude with us via our online shop is epitome GmbH, The ICON Vienna, Tower 17, 10th floor, Gertrude-Froehlich-Sandner-Strasse 2-4, A-1100 Vienna (hereinafter referred to as 'seller' or 'we').

1.2. Our online store is aimed exclusively at consumers who are at least 18 years old. A consumer is any natural person who enters into a legal transaction for a purpose that cannot be predominantly attributed to a commercial or self-employed professional activity and therefore does not belong to the operation of a business.

1.3. The deliveries, services and offers of the seller are made exclusively on the basis of these General Terms and Conditions (GTC), even if the offer is accessed from outside Austria.

 

2. Conclusion of contract

2.1. The presentation of the products in the online shop does not constitute a legally binding offer, but only a non-binding invitation to customers to order.

2.2. Your order constitutes an offer to us to conclude a purchase contract. When you place an order, we will send you an automated order confirmation that an order has been received. This order confirmation does not constitute an acceptance of your offer but is only intended to inform you that the order has been received by us. A purchase contract is only concluded when we ship the ordered product to you and the shipment to you is confirmed with a second e-mail (shipping confirmation). We are under no obligation to accept the customer's offer. If the goods you have ordered are not available at the time of your order, we will inform you of this.

2.3. We reserve the right to deliver the presented goods only in normal household quantities.

 

3. Subscription of consumables

3.1. For correct and optimal functioning, it is necessary to use the epitome consumables specially adapted to our product. We offer a consumables replacement delivery model that allows you to order a recurring shipment of certain selected products ('Subscription Products') at the price stated in the online shop.

3.2. Subscription Products are delivered on a monthly basis, unless otherwise agreed. We will invoice you for the Subscription Products prior to each scheduled shipping date and deduct the agreed price from the payment method you provided when placing your order. Subscription Products will only be shipped after we have received the monthly payment.

3.3. If you entered a subscription for Subscription Products with a minimum contract period (cancellation waiver), then you can legally cancel the subscription at the earliest at the time of the expiry of the minimum contract period. After that, you can cancel the subscription at any time with one (1) month notice to the last day of the month.

3.4. If you terminate the subscription contract subscription for Subscription Products before the end of the minimum contract period, the termination will not take effect until the earliest possible ordinary termination date.

3.5. If a Subscription Product is out of stock, we will notify you by email and we may postpone delivery (and associated costs) until the next scheduled shipping day when the subscription product becomes available again.

 

4. Pricing and Shipping

4.1. Your order will be subject to the prices shown in the online shop at the time of your order. All prices are inclusive of the statutory value added tax plus shipping costs, if applicable.

4.2. If shipping costs apply to an order, these will be clearly communicated to you on the product pages, in the shopping cart system and on the order page before you place the order. You can find an overview of all countries we ship to and countries where shipping costs are additional online at www.epitome.inc.

4.3. In the case of deliveries outside the EU, additional taxes (e.g. intra-community acquisitions and/or duties (e.g. customs duties) may be incurred in individual cases, which must be paid by the customer directly to the customs or tax authorities responsible there and not to the seller.

4.4. The estimated delivery times are indicated on the product detail page and in the shopping cart. If a product is not in stock or delivery is delayed, we will deliver as soon as possible within the scope of availability.

4.5. In case of delivery delays, we will inform you by e-mail. If you withdraw from the contract for this reason, we will refund the payments made in full immediately and at the latest within fourteen days.

4.6. If not all ordered items are in stock, we are entitled to make partial deliveries at our own expense, insofar as this is reasonable for you. A delivery of a partial number of the ordered goods is considered reasonable.

4.7. Delivery will be made by shipment from stock to the delivery address provided by you, unless otherwise agreed.

 

5. Right of withdrawal and return policy

5.1. Consumers have the right to withdraw from a contract for goods or services concluded with the seller within fourteen days without giving reasons.

5.2. The withdrawal period is fourteen days from the day on which the customer or a third party designated by him, who is not the carrier, has taken possession of the goods. In the case of a contract for several goods ordered by the Customer as part of a single order and delivered separately, the period begins from the day on which the Customer or a third party designated by the Customer, who is not the carrier, took possession of the last goods.

5.3. In order to exercise the right of withdrawal, the Customer must inform the seller of his decision to withdraw from the contract by means of a clear statement. This declaration must be sent to one of the following addresses:

5.4. The customer can use the sample withdrawal form at the end of these T&Cs for this purpose, but this is not mandatory. This sample withdrawal form is also available for download and printing at www.epitome.inc.

5.5. In order to comply with the withdrawal period, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

5.6. Consequences of revocation. If the Customer withdraws from the contract, the seller shall reimburse all payments received from the customer, including delivery costs (with the exception of additional costs resulting from the fact that the customer has chosen a type of delivery other than the cheapest standard delivery offered by the Seller), without undue delay and at the latest within fourteen days from the day on which the Seller received the notice of withdrawal from this agreement. For this repayment, the seller will use the same means of payment that the customer used for the original transaction, unless otherwise expressly agreed with the customer. In the event that the means of payment of the original transaction is not available for repayment (e.g. cash on delivery), the repayment will be made by bank transfer to a bank account to be specified by the customer or by means of a crossed cheque. Under no circumstances will the customer be charged any fees as a result of this repayment.

5.7. The seller may refuse to refund until the seller has received the Goods back or until the customer has provided proof that he has returned the Goods, whichever is earlier.

5.8. The customer must return or hand over the goods to the seller without undue delay and in any case no later than fourteen days from the day on which he informed the seller of the withdrawal from this contract. The deadline is met if the customer sends the goods before the expiry of the period of fourteen days. The seller recommends that you always return the goods in their original packaging.

5.9. In the event of withdrawal, the customer is obliged to bear the direct costs of returning the goods himself. The risk of return lies with the seller.

5.10. Goods that can be shipped must be returned with sufficient postage to epitome GmbH, The ICON Vienna, Turm 17, 10th floor Gertrude-Froehlich-Sandner-Strasse 2-4, A-1100 Vienna. The cost of an insufficiently stamped return will be charged to the customer.

5.11. The customer is only liable for any loss in value of the goods if this loss in value is due to extensive handling that is not necessary to check the nature, characteristics and functioning of the goods.

5.12. If the goods have been damaged, the customer must pay appropriate compensation to epitome for the damage incurred - up to a maximum of the value of the goods.

 

6. Waiver of the right of withdrawal

6.1. For sealed goods that are delivered in a sealed package for reasons of health protection or hygiene, the right of withdrawal does not apply if the seal has been removed after the goods have been delivered.

6.2. A right of revocation does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by you is decisive or which are clearly tailored to your personal needs.

8.1. All amounts incurred are due for payment immediately without deduction. Payment processing is carried out by external providers or payment service providers.

8.2. In the online shop we offer various payment methods.

8.3. The debit will be made upon completion of your order. Credit card transactions are processed through a third-party payment service provider. For payment via eps transfer, you will be redirected to the respective website of the provider.

 

9. Order process

9.1. You order from our online shop by following these steps.

By clicking on 'Add to cart' you place the desired item in your shopping cart without obligation. By clicking on 'Shopping Cart; you can view the shopping cart at any time and delete items or change the quantity. If you want to purchase the items from your shopping cart, click on 'Proceed to checkout'. The next step is to enter your billing and delivery address. If you already have a customer account, you can log in now and change your registered address if necessary. Click 'Continue'. In the last step, you can select a payment method and check your order and other details. If you would like to change your details, please click on 'Return to billing and delivery address' or 'Return to shopping cart'. If all the information is correct and you want to complete your order, click on 'Confirm order' The information about the time of conclusion of the contract can be found in point 2 of these GTC.

10. Warranty

10.1. The statutory warranty provisions apply to all goods purchased in our online shop. The warranty period is 24 months from the date of delivery of the goods.

10.3. Please check the goods immediately after receipt of the delivery for completeness, any defects or transport damage and report them to us immediately. However, failure to do so will not affect your statutory claims.

 

11. Liability

11.1. The seller excludes liability for slightly negligent breach of duty, provided that this does not concern damages resulting from injury to life, limb or health or warranties or claims under the Product Liability Act are affected. The above limitation of liability also applies to the persons used by the seller to fulfil its contractual obligations.

 

12. Alternative Dispute Resolution

12.1. The EU Online Dispute Resolution platform is available at the following link: http://ec.europa.eu/consumers/odr. Please note that we are not obliged to participate in such arbitration proceedings and do not offer to participate in them.

 

13. Privacy

13.1. All personal data will only be collected, stored and/or processed in compliance with the relevant provisions of data protection law. The details are contained in the privacy policy, which you can access, view, save and print out at any time on our website.

 

14. Contract language

14.1. These Terms and Conditions are provided in English for informational purposes. The German version shall be the legally binding contractual language.

 

15. Applicable law

15.1. All legal relationships between the seller and the customer are governed by the law of the Republic of Austria to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of consumer contracts, mandatory provisions of the law of the country in which the customer has his habitual residence remain unaffected.

15.2. If the customer is an entrepreneur within the meaning of the Entrepreneur Code or a legal entity under public law, the place of jurisdiction is Vienna.

 

16. Final Provisions

16.1. Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
